KOURT Participant Agreement and Waiver

By registering for and paying for a KOURT program, the parent or guardian (“you”) agrees to the following on behalf of themselves and the registered child.

1. Risks of sport
Tennis and pickleball are physical activities. Like any sport, they carry a risk of injury, including those resulting from slips, falls, and collisions with objects or other players. Players may also be hit by balls, paddles or racquets, particularly at young ages when body awareness and emotional control are not yet fully developed. Despite our efforts to reduce such risks, they cannot be completely eliminated. You understand these risks and accept them for your child. You agree not to hold KOURT, its directors, host facilities, or any coaches or volunteers who deliver our programs responsible for injuries that happen during the course of normal participation, to the extent allowed by law and provided they are not the direct result of gross negligence by any of the parties above.

2. Health and safety
You confirm that your child is healthy enough to take part. Prior to the first class, you will tell us by email about any allergies, medical conditions or needs we should know about. You will send your child to class with a water bottle and dressed in proper running shoes and attire for the weather. You will keep your child home if they are ill, especially if they are not well enough to play safely or could pass an illness on to others.

3. Emergencies
If your child is injured or becomes ill, their coach will inform you immediately. If you are not on site, you will be contacted at the phone number you provided on your registration form; a list of parent phone numbers will be on site. The coach will escort your child to a safe, comfortable location on site and ensure that they are being monitored. Minor first aid (e.g., bandages for cuts) may be provided by the coach, and a small first aid kit will be on site for that purpose. If you are not there to make decisions, the coach may call 911 to get assistance if they have any concern about your child’s health being in jeopardy if they do not receive some form of formal treatment. If you are on site, decisions about further care will normally be left to you; however, in a serious or life-threatening emergency, the coach may call 911 at any time. Any resulting medical or ambulance costs not covered by OHIP will be your responsibility. The coach may also designate any of the actions above to another coach, volunteer or parent if it is appropriate in light of the severity of the injury or illness and the human resources available at the time.

4. Behaviour
We want our programs to be safe, fun and respectful learning environments. Your child is expected to follow coaches’ instructions and treat others kindly. We ask that you make your child aware of these expectations and, if necessary, step in and help the coach deal with any behaviour issues. If your child’s behaviour repeatedly puts others at risk, or prevents us from providing all kids with a quality experience, the coach will first bring this to your attention. In rare cases where it cannot be resolved, we may remove your child from the program (see section 9 for refunds).

5. Drop-off, pick-up and supervision
Your child is under our care only during their scheduled program (e.g., class) time. Please arrive on time for pick-up and let us know if someone else will be picking up your child. If your child is very young, we ask that you stay at the court to reassure them and help them stay focused. Where necessary, we also ask that you stay so you can help monitor and correct any poor behaviour (see section 4). Siblings and other family or friends who are near the court during your child’s class (for example, while waiting for their own class to begin) do not fall under the coach’s supervision. You need to ensure that they stay safely away from the play when they are not participating in a program, so that they are not injured and do not cause injury to participants.

6. Photos and videos
We sometimes take photos and videos during our programs and various club events to share on our website, social media and promotional materials. They are an important tool for promoting the work we are doing in the community, so that even more kids can benefit. Photos are typically taken in a group setting, and we do not include names. However, if you would prefer that your child not appear in photos or videos, just email us any time at kourtclub@gmail.com.

7. Your privacy
We collect your contact details and your child’s name, age and relevant health information only to run our programs and communicate with you. We do not sell or share your information with anyone outside KOURT, except where needed in an emergency or required by law. To see, correct or delete your information, email us.

8. Class placement and changes
We may sometimes need to move your child to another class once we have had a chance to assess them, or to balance out the levels of all of the kids who ultimately enroll. This may result in your child’s class time differing from the one you originally selected. If a change doesn’t work for you, you are entitled to a refund (see section 9).

9. Cancellations, make-ups, credits and refunds
If your child is new to KOURT, we offer a money-back guarantee: if you do not wish to continue after their first class, simply let us know within 24 hours and you will receive a full refund of fees paid for that season of classes. If you enrolled your child in a class on a particular day and time and KOURT ultimately needs to change it for whatever reason, you are also entitled to a full refund of that class for the season if the new day or time does not work for you. In all other cases, program registrations are typically final. When classes are cancelled on account of the weather or other unexpected events, you will be offered make-up classes or equivalent credits toward future program offerings. In the rare case that your child is removed from a program for behavioural reasons (see section 4), you will also receive a refund for the remaining unused classes in that season.
